What Association Documents Does a Province Sale Require?

When a Province home sells, Arizona's planned-community statute (A.R.S. 33-1806) requires the seller to provide the buyer with the association's resale disclosure statement and governing documents, and the buyer gets a review period. The package comes from the Province Community Association office and includes the CC&Rs, current policies, the budget and reserves, and the status of the seller's account. The association charges a document fee, typically paid by the seller, and transfer and capital charges at closing per its fee sheet. Amounts are the association's and are not printed here.

What Arizona requires

Under A.R.S. 33-1806, the seller of a home in a planned community must furnish the buyer, before closing, a resale disclosure statement from the association covering the assessment, any unpaid amounts, pending litigation, the governing documents, and other items the statute lists, and the buyer has a statutory period to review and cancel. What is in the package

  • The recorded CC&Rs and any amendments.
  • The association's current rules and policies, including age qualification, leasing, guests, pets, and vehicle rules.
  • Design guidelines for exterior changes.
  • The current budget, reserve information, and financial statements.
  • The seller's account status: assessments paid, any open balance, violations, or pending matters.
  • Any pending special assessment or litigation disclosure.
  • The association's resale fee sheet.

Who pays what

Per the association's fee sheet: a document or disclosure fee for producing the package, typically paid by the seller; a transfer or processing charge; and a capital contribution paid by the buyer at closing. Timing

Order at listing. The association needs time to produce the package, and the buyer's review period does not start until they receive it. The buyer's age qualification

Separately from the documents, the association verifies that the incoming household meets its occupancy policy at transfer. The buyer handles that paperwork; the seller's role is to close on time once it is complete. The concept is explained on the 55+ occupancy rules.

Your own disclosures

The association package is the association's. Your own disclosures come after listing: the Arizona Seller's Property Disclosure Statement, in which you disclose what you know about the home, and the C.L.U.E. report, which shows insurance claims on the property.
